LAS VEGAS FAMILY LAW GUIDE

The Five Stages of a
Contested Divorce in Clark County

Every contested divorce in Las Vegas moves through a structured legal process inside the Eighth Judicial District Court. Understanding each phase helps clients prepare for custody issues, financial disclosures, settlement negotiations, court hearings, and long-term case strategy.

1

Uncontested Divorce

Both spouses sign a Joint Petition under NRS 125.181–125.184 and agree on community property, debt, custody, parenting time, child support, and any applicable spousal support. Typical legal fees: $2,500–$5,000
Estimated timeline: 1–3 weeks

2

Contested Divorce

One spouse files a Complaint for Divorce, the other spouse is served and responds, and the case proceeds through the Family Division of the Eighth Judicial District Court. Typical legal fees: $10,000–$30,000+
Often resolved before trial

3

High-Conflict Divorce

These cases may involve hidden assets, domestic violence allegations, custody disputes, relocation issues, or complex motion practice requiring experts and detailed court involvement. Timeline: 12–24 months
Cost may exceed $30,000–$50,000+

4

Default Divorce

If a served spouse fails to respond, the court may grant a default divorce. However, proper service is required, and the court still reviews the Decree for fairness. Not always a shortcut
Defaults may be challenged later
